1. Agreement
These Terms and Conditions ("Terms") govern the provision of driving instruction services by James
Driving School
("we", "our", "us") to students ("you"). By booking or attending lessons, you agree to be bound by these
Terms.
2. Eligibility
To enrol, you must:
- Hold a valid Australian learner’s permit or licence relevant to the vehicle (or a recognized
international licence with English
translation).
- Meet the legal driving age requirements.
- Disclose any medical conditions, medications, or limitations affecting driving ability.
- Present your physical licence at the start of every lesson. We reserve the right to refuse or
suspend services if safety risks or
licensing issues are identified.
3. Services
We provide:
- Driving lessons (manual and automatic).
- Driving test preparation and assessment readiness.
- Use of an instructor vehicle for driving tests (subject to prior booking and instructor approval).
4. Bookings & Scheduling
- Bookings are confirmed upon payment or deposit.
- Start times are approximate; instructors may be delayed by up to 15 minutes due to traffic or prior
lessons. We will endeavour to
notify you of significant delays.
- We reserve the right to reschedule lessons due to mechanical failure, instructor illness, or extreme
weather.
5. Payment Terms & Tolls
- All lessons must be paid in advance unless otherwise agreed.
- We accept cash, card, and secure online payments.
- Tolls: Unless otherwise stated, any road tolls (e.g., e-Toll) incurred during a lesson are the
responsibility of the student and may
be charged in addition to the lesson fee.
6. Cancellations & Rescheduling
- 24-Hour Rule: A minimum of 24 hours’ notice is required to cancel or reschedule a lesson.
- Late Cancellations: Cancellations made within 24 hours of the lesson will result in the
forfeiture of the full lesson fee.
- No-Shows: If you are not at the designated pickup location within 15 minutes of the start
time, the instructor will depart and the
full fee will be forfeited.
7. Refund Policy
- Refunds are provided in accordance with the Australian Consumer Law.
- No Refunds: Will be issued for late cancellations, missed lessons, or "change of mind" once a
service or package has commenced.
- Admin Fee: Refunds for unused pre-paid services may be subject to a small administration fee.
8. Lesson Packages
- Packages must be used within 6 months from the date of purchase.
- Unused lessons after the expiry date will be forfeited.
- Packages are non-transferable.
9. Student Responsibilities & Conduct
- You must follow all road rules and instructor directions immediately.
- Zero Tolerance: You must not be under the influence of drugs or alcohol. We maintain a
zero-tolerance policy for aggressive, abusive,
or disrespectful behaviour.
- Safety: If an instructor deems your driving or behaviour to be a safety risk, the lesson will
be terminated immediately without a
refund.
10. Vehicle Use & Liability
- Instructor Vehicle: Lessons are conducted in dual-controlled, insured vehicles.
- Student Vehicle: If using your own vehicle, it must be roadworthy, registered, and have
comprehensive insurance that covers
professional driving instruction. We accept no liability for damage or mechanical failure in a
student-supplied vehicle.
- Fines: Any traffic infringements (speeding, red lights, etc.) incurred during a lesson are the
legal and financial responsibility of
the student.
11. Driving Test Conditions
- Use of the school vehicle for a driving test is at the instructor's discretion.
- We are not responsible for test outcomes, nor for tests cancelled or delayed by Transport for NSW or
other government authorities.
12. Driving Test Bookings & Responsibility
- Learners are responsible for ensuring they meet all NSW driving test requirements on the scheduled test day,
including carrying valid identification, logbook completion, and any required documentation.
- If the driving test cannot be conducted due to incomplete documents, failure to meet eligibility requirements, or any issue from
the learner’s side, the booking will be considered used and no refund will be provided.
13. Dashcam & Audio Consent
For safety, insurance, and training purposes, our vehicles may be equipped with dashcams recording video
and audio. By attending a lesson, you consent to these recordings as outlined in our Privacy Policy.
14. Limitation of Liability
To the extent permitted by law, our liability is limited to the value of the services paid. We are not
liable for any indirect, consequential, or physical loss arising from the use of our services, provided
we have exercised reasonable
care and skill.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
